1. ELIGIBILITY

This GanjaVacations/HITOKI Giveaway ("Sweepstakes") is open to residents of the

50 United States and the District of Columbia who are lawful U.S. residents, are 21

years of age or older at the start of the Sweepstakes ("Entrants"). The Sweepstakes

is sponsored by GanjaVacations and HITOKI ("Sponsors"). Anyone who has won a

competition or sweepstakes within the past 365 days from Sponsors is not eligible

for entry. Employees of Sponsors and their parents, subsidiaries, affiliates, directors,

owners, and agents are not eligible to participate or win. Void outside of the United

States and where prohibited by law.

2. MANDATORY INSTAGRAM, FACEBOOK, TWITTER DISCLOSURE

This Sweepstakes is in no way sponsored, endorsed or administered by, or

associated with Instagram, Facebook, or Twitter. You are providing your information

to the Sponsors and not to Instagram, Facebook, or Twitter. The information you

provide will only be used for administering these Sweepstakes. Your entry

constitutes a full release of Instagram, Facebook, or Twitter with respect to any

claims you may have arising out of participation in this Sweepstakes.

3. SWEEPSTAKES PERIOD. 

The Sweepstakes begins at 12:00 a.m. Central Time ("CT") on April 2, 2024, and

ends at 11:59 pm CT on July 10, 2024 (the "Sweepstakes Period").

4. HOW TO ENTER.

There is one way to enter. Via the online website, you must visit http://hitoki.shop/giveaway-240vaction to enter, at minimum, your full name and email address. According to the Sponsors’

time clock, all online entries must be received by 11:59 p.m. CT on July 10, 2024.

Incomplete, garbled, corrupted, or otherwise illegible entries are void and will not be

accepted. The sponsors reserve the right to disqualify false entries or entries

suspected of being false. All entries submitted become the sole property of the

Sponsors and will not be acknowledged or returned. In the event of a dispute as to

the identity of a winner, the winner will be deemed to be the person in whose name

the email account governing the email address used in the registration form was

opened.

5. ODDS.

 The odds of winning a prize depend on the number of eligible entries received.

6. SELECTION AND NOTIFICATION OF SELECTED ENTRANT

Each qualified entry will be entered into the random drawing for one prize. A random

drawing by a representative of the Sponsors, from among all eligible entries received

during the Sweepstakes Period, will be held on or about July 10, 2024 , ("Drawing

Date") to determine one grand prize winner ("Selected Entrant"). Selected Entrant

will be notified by email within approximately 3 days after the Drawing Date

("Notification"). The Selected Entrant will be required to respond (as directed) within

5 days of attempted notification. Selected Entrant’s failure to respond timely to the

Notification may result in forfeiture of the prize. In such case, the Sponsors may

randomly select an alternate Selected Entrant from among the remaining eligible

entries. Except as prohibited by law, the

Selected Entrant will be required to complete and return a declaration of eligibility /

liability / publicity release ("Release") within the time period specified therein,

allowing the Sponsors to use (without additional compensation) Selected Entrant’s

name, address, photograph, testimonial, likeness, and/or biographical information for

purposes of advertising and promotion (including, without limitation, posting on

Sponsors’ website(s) and affiliated website(s)). Selected Entrant will be required to

submit proof of age, including but not limited to transmitting an electronic image of

an official, state-issued identification card or driver’s license and may be required to

provide a U.S. Social Security Number (for tax form purposes), birth date, current

address, and phone number. The prize may be forfeited, and in such case, an

alternate Selected Entrant may be randomly selected from among the remaining

eligible entries if the Selected Entrant: (i) cannot be reached; (ii) does not respond to

the Notification within 7 days; (iii) fails to obtain all signatures on the Release and to

return the documents in a timely manner as required pursuant to these Official

Rules; or (iv) cannot accept or receive the Grand Prize for any reason. Non-

compliance with these Official Rules may result in disqualification and selection of an

alternate Selected Entrant.

7. PRIZES.

Grand Prize (1 winner): One Grand Prize winner will receive: i) 4-day/3-night

accommodations plus meals for 2 people at Negril Blue Sky Resorts in Negril,

Jamaica, ii) pickup from Sangster International in Montego Bay Airport, and iii)

dispensary visit in Montego Bay after airport pickup, together, the Accommodations

The approximate value of the Accommodations is $1,000. The Grand Prize does not include airfare. Booking at Negril Sky Blue Resorts will be

subject to availability. GanjaVacations is

responsible for Accommodations. Hitoki is not responsible for Accommodations;

GanjaVacations/Hitoki is not responsible for Airfare. Secondary prizes: all entrants will

receive a time-delimited coupon code for a 15% discount on a couple’s vacation

package bookings on GanjaVacations.net, valid until October 14, 2025. Any difference

between the actual value and the actual retail value will not be awarded. Prizes are

not transferable and are non-refundable. No substitution, transfer, or cash

redemption of the prize is provided; however, the Sponsors reserve the right to

substitute a prize with another prize of equal or greater value should the advertised

prize become unavailable and to not award the Grand Prize if an insufficient number

of eligible entries are received. 

All details regarding redemption of the prize are at Sponsors’ sole discretion and will

be provided at the time of Selected Entrant’s Notification. If a Selected Entrant is

unable to participate in or accept the prize or any portion of the prize for any reason

the prize will be forfeited, and Sponsors shall have no further obligation to the

Selected Entrant. The Grand Prize winner must redeem the Grand Prize by April 20, 2025.

8. CONDITIONS. 

This Sweepstakes is subject to all applicable federal, state, and local laws of the

United States. By participating, Selected Entrant agrees to be fully and

unconditionally bound by these Official Rules and Sponsors’ decisions and waive

any right to claim ambiguity in the Sweepstakes or these Official Rules. All federal,

state or other tax liabilities (including income taxes) arising from this Sweepstakes

will be the sole responsibility of Selected Entrant, and Selected Entrant may be

issued an IRS Form 1099 for the ARV of any awarded prize.

Selected Entrant agrees to release, discharge, indemnify and hold harmless

Sponsors, and their officers, directors, employees, representatives and agents from

and against any claims, damages, disability, attorneys'; fees, and costs of litigation

and settlement, as well as any liability due to any injuries, damages or losses to any

person (including death) or property of any kind resulting in whole or in part, directly

or indirectly, from: (i) use, redemption, acceptance, possession, ownership, or

misuse of any prize, (ii) participation in any activity, event, or excursion offered in

connection with the prize, (iii) use of any facility, service and/or accommodation

related to the prize, or (iv) participation in any Sweepstakes-related activity or

participation in this Sweepstakes.

Sponsors reserve the right to disqualify any Entrant they find to be tampering with

the entry process or the operation of the Sweepstakes or violating these Official

Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent

to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy,

abuse, threaten or harass any other person, and Sponsors reserve the right to seek

damages and other remedies from any such person to the fullest extent permitted by

law. Any portion of the Sweepstakes may be canceled, suspended, and/or modified,

in whole or in part, if in Sponsors’ opinion, any fraud, technical failure or other factors

beyond their control impairs the integrity or proper functioning of the Sweepstakes,

and Sponsors reserve the right at their sole discretion to terminate the Sweepstakes

and, if terminated, at their discretion, select the potential winner(s) in a random

drawing from among all eligible, non-suspect entries received prior to action taken.

You may not enter with multiple identities or use any automated system, bot, or

other device or artifice to enter or obtain more than one qualified entry. Unclaimed

prizes will not be awarded. 

Sponsors shall not be liable for: (i) late, lost, delayed, void, corrupted, misdirected,

incomplete, unreadable, inaccurate, garbled, or unintelligible entries,

communications, or declarations, regardless of the method of transmission; (ii)

telephone system, telephone or computer hardware, software or other technical

malfunctions, bugs, lost connections, disconnections, delays or transmission errors

Sweepstakes Entrants may encounter when submitting their entry; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other

materials; (iv) any injuries, losses or damages of any kind caused by a prize or

resulting from acceptance, possession or use of a prize, or from participation in the

Sweepstakes; or (v) any printing, typographical, administrative or technological

errors in any materials associated with the Sweepstakes.

Disputes regarding these Official Rules and/or this Sweepstakes will be governed by

the internal laws of the State of Georgia. By entering, you consent to jurisdiction in the

federal and state courts of Georgia for the resolution of any and all disputes. Caution:

Any attempt to deliberately damage or undermine the legitimate operation of the

sweepstakes may be in violation of criminal and civil laws and will result in

disqualification from participation in the sweepstakes. Should such an attempt be

made, Sponsors reserve the right to seek remedies and damages (including attorney

fees) to the fullest extent of the law, including criminal prosecution.

9. PRIVACY

All personal information collected by the Sponsors will be used for administration of the Sweepstakes. The Sponsors will comply with Federal CAN-SPAM requirements, and Entrants may subsequently opt out of receiving further emails by following the opt-out instructions contained in the email.
